A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

On August 12, 2015, the Defendant: (a) on August 20: 20:07, the Defendant, at the window C of Changwon-si, recommended a police officer to return home from the police officer who was reported at the instant singing room 112 and called the taxi after receiving a report at the said singing room 112; (b) on the other hand, the Defendant was able to take a bath without the destination of the taxi officer, and was able to see the taxi engineer to go to the E area.

피고인은 2015. 8. 12. 20:50경 E지구대 출입문 앞에서 “야이 씨발 놈들아 내가 뭘 잘못 했노, 이 좆같은 새끼들아” 등의 욕설을 하며 소란을 피우고, “어린 새끼들이라서 일을 똑바로 못한다. 민주경찰은 그렇게 일하면 안 된다. 씨발, 한판 붙어보자”라면서 경위 F에게 달려들었고, 이에 순경 G, H으로부터 제지당하자 손으로 순경 G의 가슴을 2-3회 밀치고 발로 낭심 부위를 1회, 왼쪽 허벅지 부위를 2회 찬 뒤 손으로 멱살을 잡아 흔들어 폭행하고, 손으로 순경 H의 가슴을 1회 밀치고 주먹으로 왼쪽 팔뚝과 가슴을 각 1회 때리고 발로 오른쪽 정강이 부위를 1회 차 폭행하였다.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers on the duty of global guard.

The reason for sentencing under Article 62(1) of the Criminal Act in the suspension of execution is that the defendant is under the influence of alcohol and assaults the police officers who restrain the disturbance at the police station boundary, thereby obstructing the execution of official duties, and thus, the crime is not less severe: Provided, That the execution of the sentence is suspended in consideration of the defendant's age, character and conduct, family environment, motive and circumstance of the crime, motive and consequence of the crime, and circumstances after the crime.
