The prosecutor's appeal is dismissed.

The grounds for appeal (misunderstanding of the facts) are as follows: (a) the Defendant, by deceiving the victims by taking so-called “the victims’ re-determination”; and (b) in such a case, the number of copies subject to the death by the victims shall be included in the number of actual sales; (c) however, the lower court erred by misapprehending the facts,

2. A thorough examination of the evidence duly adopted and examined by the court below in light of the records, the defendant did not seem to have been killed by the victims on the basis of the judgment of evidence as stated by the court below.

In determining that the evidence of this case alone is not sufficient to readily conclude that the defendant had the intention of deceiving or deceiving the victims, and thus, the court below's decision that the defendant was not guilty of the facts charged of this case is just.
