피고인은 2018. 7. 29. 16:20경 안산시 단원구 B에 있는 피해자 C 운영의 ‘D’이라는 상호의 주점에서 혼자 술을 마시던 중, 피해자로부터 “술을 많이 드셨으니 조용히 돌아가세요.”라는 말을 듣자 화가 나 피해자에게 “너 뭐냐, 나랑 한 번 해 보자는 거야.”라고 말하며 소란을 피우고, 이에 옆 테이블에서 술과 음식을 먹고 있던 피해자의 지인 중 한 명인 E가 피고인을 제지하였음에도 위 E와 배를 주먹으로 1회 때리고, 피해자의 지인들이 있는 테이블 쪽으로 다가가 “이 개새끼야 죽을래.”라고 욕설을 하며 시비를 걸고, 주먹으로 때릴 듯 한 시늉을 하고, 테이블 칸막이를 손으로 수회 가격하는 등 약 10분간 위력으로써 피해자의 주점 운영 업무를 방해하였다.
