1. The Defendants jointly and severally against the Plaintiffs:
(a) KRW 3,908,532, respectively, and its related thereto, from November 12, 2014 to December 2, 2015.
Reasons
1. Facts of recognition;
A. On March 23, 2009, the Plaintiffs completed the registration of ownership transfer with respect to each of 1/2 shares of C forest land 73,488 square meters (hereinafter “instant forest”) in Seoul Special Metropolitan City, Nowon-gu.
B. On July 9, 1977, the Minister of Construction and Transportation, including the instant forest, determined the area of 6,692,700 square meters for the land on the same day (hereinafter “the instant park site”) as an urban planning facility (park), and publicly announced it on July 14, 197 as D, and publicly notified on November 23, 1989 as E-public notification of the Ministry of Construction and Transportation, and the Mayor of Seoul Special Metropolitan City publicly notified on December 4, 1989, issued a cadastral approval and public notification on the plan to create the approved mountain natural park, but on February 26, 1998, publicly notified on February 26, 199 as the Seoul Special Metropolitan City public notification.
C. Defendant Nowon-gu in Seoul Special Metropolitan City (hereinafter “Defendant Nowon-gu”) delegated the administrative affairs of urban natural parks from Defendant Seoul Special Metropolitan City (hereinafter “Defendant Seoul Special Metropolitan City”) and manages the Nowon-gu District including the instant forest from among the city natural parks that are acceptable.
피고 노원구는 이 사건 임야 내에 별지 2 도면에서 별지 1 목록 기재 부분 중 ‘ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅍ, ㅎ, ㄱ1, ㄴ1, ㄷ1, ㄹ1, ㅁ1, ㅂ1, ㅈ2, ㅊ2, ㅁ3, ㅅ1, ㅇ1, ㅁ2, ㅅ2, ㅇ2, ㅋ2, ㅌ2, ㅍ2, ㅎ2, ㄱ3, ㄴ3, ㄷ3, ㄹ3, ㄱ2, ㄴ2, ㄷ2, ㄹ2, ㅌ1, ㅍ1, ㅎ1’ 부분(이하 ‘이 사건 종전 점유 부분’이라 한다)에 해당 각 시설물을 설치한 후 이를 관리하고 있다.
마. 이 사건 임야는 2014. 11. 5. 위 C 임야 70,938㎡와 H 임야 2,550㎡로 분할되었는데, 피고 서울시는 2014. 11. 13. 이 사건 임야의 별지 2 도면에서 별지 1 목록 중 ‘ㄱ2, ㄴ2, ㄷ2, ㄹ2, ㅌ1, ㅍ1, ㅎ1’ 부분을 포함한 위 H 임야 2,550㎡에 관하여 2014. 11. 12. 공공용지의 협의취득을 원인으로 한 소유권이전등기를 마쳤다.
