1. Nonparty N Co., Ltd.:

A. Defendant B shall be the Incheon District Court with respect to each real estate listed in the separate sheet.

1. Basic facts

A. (1) On November 8, 2000, the Plaintiff changed the name of N Co., Ltd. prior to N Co., Ltd. to “S.” on the following grounds: (a) February 1, 2001; and (b) March 2, 2003, respectively.

From the perspective of the Incheon Nam-guO (hereinafter referred to as the “instant site”) concluded a construction contract with the content that the construction work for the construction of the main complex building with the size of the 4th underground floor and the 11th floor above the ground (hereinafter referred to as the “instant officetel”) shall be KRW 7,205,00,000 for the construction cost.

Accordingly, even though the Plaintiff’s construction of the instant officetel was carried out, the construction was suspended on July 2002, and the said construction contract was rescinded on August 21, 2002.

B. The Plaintiff filed a lawsuit against N in 2006, and the appellate court rendered a judgment that “N shall pay to the Plaintiff KRW 2,603,527,789, and damages for delay for the payment of the prepaid construction cost after deducting approximately KRW 4.1 billion of the prepaid construction cost of KRW 6.7 billion (Seoul High Court Decision 2008Na8933, Feb. 13, 2013), and the above judgment became final and conclusive around that time.

나. 건축주 명의 변경 및 P 주식회사 명의의 소유권보존등기 ⑴ 이 사건 오피스텔 신축공사가 중단된 후, 위 공사의 건축주는 N에서 Q, R, 주식회사 하이팰리스(이하 ‘하이팰리스’라 한다) 등으로 순차 변경되었다가, 2007. 6. 18. 하이팰리스에서 N로 변경되었고, 같은 날 N에서 P 주식회사(이하 ‘P’이라 한다)로 다시 변경되었다.
