1. 특수절도 피고인은 2013. 7. 16. 00:00경부터 02:00경 사이 군산시 B에 있는 피해자 C 운영의 ‘D’ 식당에 이르러 소지하고 있던 드라이버로 음식점 뒤편에 있는 잠긴 주방 창문의 나사를 풀고 힘으로 당겨 창문을 부숴 손괴한 다음 창문을 통하여 주방 안까지 침입하여 그곳 카운터에 있는 피해자 소유의 현금 2만 원과 냉장고 안에 있는 피해자 소유인 시가 합계 113,500원 상당의 골뱅이 캔 6개 등 식품 26개를 꺼내어 들고 나와 절취하였다.
