Reasons
Punishment of the crime
[criminal history] On December 20, 2012, the Defendant was sentenced to one year and six months of imprisonment with prison labor by obstructing business operations at the Suwon, and on February 23, 2014, at the Net Prison, ten times the criminal records of the same kind, including the termination of the execution of the sentence.
[Criminal facts]
1. On April 27, 2016, at around 11:20, the Defendant, under the influence of alcohol in the BG restaurant operated by the victim BF located in Suwon-gu, Busan, the Defendant: (a) took a serious bath for the victim without any justifiable reason; (b) provided that the victimized person was aware that the said restaurant can only be delivered and could not take meals at the restaurant; (c) provided that the victimized person continued 20 minutes of the disturbance on the ground that the victim did not receive an order for meals, thereby obstructing the victim’s duties concerning the said restaurant business by force.
2. On April 27, 2016, the Defendant, at around 13:00, intended the victim BH operated by the victim BI in Suwon-gu, Busan, and took the victim’s bath under the influence of alcohol, and the Defendant’s bH displayed at that place.
In the case of a marina room, the victim's 30 minutes of disturbance was obstructed by force by avoiding the disturbance and obstructing the business of the victim's mat business.
3.
