1. The Defendants shall jointly and severally pay to the Plaintiff KRW 196,094,460 and the interest rate thereon from October 6, 2018 to the date of full payment.
Reasons
1. Facts of recognition;
A. On January 26, 2016, the Plaintiff, a corporation engaging in housing construction business and interior fishery business, was appointed as the Plaintiff’s internal director on the part of the representative director D’s spouse.
Defendant B (hereinafter “Defendant Company”) is a corporation that is engaged in real estate leasing business, etc., and Defendant C served as an inside director of the Defendant Company after March 23, 201, and Defendant C’s co-born F was appointed as the representative director of the Defendant Company on July 16, 2012, but resigned on September 30, 2015.
B. The Plaintiff used the Defendant Company as its office or leased to a third party, Seongdong-gu Seoul Metropolitan Government Building 2nd underground floor, etc.
C. On October 30, 2015, the Defendants and the Plaintiff confirmed that the amount of unpaid construction expenses for the second floor household exhibition and the large number of construction works (seven cases) of the G building that the Plaintiff completed from December 2012 to March 2014 was KRW 234,510,00, and that the amount of unpaid construction expenses was KRW 38,415,540, deducted from the unpaid rent of KRW 38,415,540, the Plaintiff confirmed that the amount of final construction expenses was the amount of final construction expenses, and confirmed that the amount of unpaid rent was the amount of final construction expenses and promptly performed the settlement of the amount of the debt. D. The Defendant prepared and issued a written confirmation of the obligation of construction expenses (hereinafter “instant confirmation”).
