1. Summary of grounds for appeal;

가. 검사 ⑴ 사실오인 또는 법리오해 ㈎ 피고인 A, B의 주식회사 AA 관련 뇌물수수 및 뇌물공여의 점 피고인 A은 한국에너지기술연구원의 직무와 밀접한 관계가 있는 행위와 관련하여 주식회사 AA의 상무인 피고인 B로부터 금원을 교부받았고, 이러한 금원은 주식회사 AA와 체결한 자문계약에 따른 정상적인 자문료 등 직무 외 행위에 대한 사례로 지급받은 것이라고 볼 수 없으므로 직무관련성이 인정된다.

Nevertheless, the lower court determined that Defendant A did not have a duty relationship with the money received from Defendant B.

Therefore, the judgment of the court below is erroneous in the misapprehension of legal principles as to duties or duties, which affected the conclusion.

㈏ 피고인 A, C의 주식회사 W, 주식회사 AW 관련 뇌물수수 및 뇌물공여의 점 검사가 제출한 증거에 의하면 피고인 A은 업무관계에서 그 직무의 대상이 되는 사람인 피고인 C로부터 금품을 수수하였고, 피고인들 사이에 이를 수수할만한 특별한 사정은 존재하지 아니하므로 피고인 A이 받은 금품과 피고인 A의 직무 사이에 관련성이 인정된다.

Nevertheless, the lower court determined that Defendant A did not have a duty relationship with the money received from Defendant B.

Therefore, the judgment of the court below is erroneous in the misapprehension of legal principles as to job relationship.

㈐ 피고인 A의 각 사기의 점 피고인 A은 한국에너지기술연구원, BY학회, CU종교단체 총무원에 가공 업체에 대한 연구용역비 또는 가공 연구원 등의 인건비 등의 명목으로 용역대금을 청구하여 이를 수령하였다.

However, the above Korea Energy Technology Institute, the BYI Association, and the General Council members of the CU Religious Organizations would not pay the service cost if they knew of the claim for processing personnel expenses as above.
