Reasons
Punishment of the crime
The Defendant sublet the bath and the fourth floor resting room operated on the second and third floor of the building in Yongsan-gu Seoul Metropolitan Government to the victim D to operate a bath. The facts for 20 months from June 2011 to January 2013 are 27,50,970 electricity charges imposed by the Korea Electric Power Corporation on the subject matter are 27,50,970, and the water charges imposed by the Central Waterworks Corporation from May 31, 201 to January 31, 2013 are 4,092,840 won in total, which are 31,593,810 won in total and 42,762,00 won in the electricity charges and water charges imposed on the victim during the said period were deceiving the victim as if the electricity charges and water charges imposed on the victim were 4,76,700 won.
The Defendant received the above sum of the electricity and water supply charges from the victims every month, and received the benefits of KRW 11,168,190 over 18 times in total by receiving less than the amount claimed in the notice as above.
In the event that the Defendant leased and operated the second to fourth floors among the buildings located in Yongsan-gu Seoul Metropolitan Government and owned by the Victim E in the name of his/her husband F, the Defendant:
(a) From April 2011, a parking lot is used, unlike its original purpose, by storing wastes at the entrance door of the first floor parking lot of the building in question and selling them on the water;
B. On September 15, 2013 and the 17th day of the same month, the utility of the building is impaired by means of pressing cement lines to prevent the entrance and exit of the said victim into an attached parking lot to the first floor of the building in which the said victim was prohibited from entering by means of telecodings during the period from two nights to five:00 a.m. on September 15, 2013; and
C. on September 2009, the victim was stolen by bringing well the pipes for sewage pipes at the entrance of the 1st floor of the building owned by the victim;
D. On April 201, around the instant building owned by the victim, the boiler and boiler pipes were stolen.
