Reasons
1. The court's explanation on this part of the basic facts is identical to the reasoning of the judgment of the court of first instance as stated in paragraph (1) of the same Article. Thus, this part is cited in accordance with the main sentence of Article 420
2. The plaintiff's assertion
A. The first real estate was purchased by the Plaintiff with respect to Defendant C Educational Association and it was title trust to Defendant C Educational Association.
In addition, the second real estate was exchanged with the original real estate of this case, and the original real estate of this case was registered in title to the defendant Chy Association by purchasing it by the plaintiff, and thus, the second real estate is also in the title trust relationship with the defendant Chy Association.
The title trust agreement between the plaintiff and the defendant Chy Association on the first and second real estate shall be null and void in violation of the Act on the Registration of Real Estate under Actual Titleholder’s Name (hereinafter “Real Estate Real Name Act”), and the agreement terminated in violation of the prohibition against disposing of the real estate trusted by the defendant Chys to a third party. Accordingly, the ownership transfer registration on the first and second real estate completed in the future of the defendant Chys Association is entirely null and void. Thus, the plaintiff has the right to seek the implementation of the procedure for the registration of cancellation of the first ownership transfer registration against the defendant Chys Association.
B. The registration of the second ownership transfer of the defendant incorporated foundation, which had been completed by the defendant C&C association on the real estate of this case, was not passed through a resolution of the general meeting of the members of the defendant C&C association, but the registration of the second ownership transfer of this case is invalid based on illegal acts, such as submitting the forged articles of association of the defendant C&C association while filing an application for registration to the effect that the donation, which is the grounds for registration, is in accordance with the resolution.
