A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On April 23, 2013, the Defendant was sentenced to six months of imprisonment for violating the Military Service Act in the Suwon District Court’s Ansan Branch, and completed the execution of the sentence in the Sungsung Vocational Training Correctional Institution on October 22, 2013.

The Defendant, as a social work personnel, was placed in the Gyeonggi-do Si Viewing and Viewing Department C from October 27, 2014, and served in the field of general administrative support.

During that period, the Defendant left from office for at least eight days in total without justifiable grounds by failing to leave from office from November 3, 2014 to February 26 of the same month.

The reason for sentencing Article 35 of the Criminal Act, among repeated offenders, takes into account the fact that the Defendant again commits the same type of crime during the period of repeated crime into account the unfavorable circumstances, and the Defendant appears to have an attitude against the instant crime, and the Defendant is able to faithfully engage in social service during the remaining service period, taking into account the favorable circumstances, setting the period of punishment such as the Disposition.

It is so decided as per Disposition for the above reasons.
