1. The Defendants are jointly and severally liable to the Plaintiff for KRW 21,806,130 and KRW 21,238,036 among them.

1. Facts of recognition;

A. On February 1, 2013, the Plaintiff entered into an automobile installment loan agreement (hereinafter “instant loan agreement”) with Defendant A with each of the terms “35,00,000,000 won per annum, 6.6% per annum, and 36 months per annum,” and on the same day, Defendant B guaranteed Defendant A’s obligation for loans under the instant loan agreement.

B. At the time of the instant loan agreement, Defendant A agreed to lose the benefit of time and pay damages for delay calculated by applying the overdue interest rate of 24% per annum on the remaining principal of the loan and its remaining principal when the ground for the loss of the benefit of time stipulated in the Plaintiff’s basic terms and conditions

C. On September 20, 2014, Defendant A lost the benefit of time due to delay in the repayment of the principal and interest under the instant loan agreement. The remainder of the loan principal under the instant loan agreement was KRW 21,238,036, and the unpaid interest up to that time, damages for delay, etc. was totaled KRW 568,094 (=40,239,127,855).

According to the above facts of determination, the Defendants are jointly and severally liable to pay to the Plaintiff 21,806,130 won (=21,238,036 won) plus the remaining principal and interest of loans, etc. under the loan agreement of this case (=21,238,036 won 568,094 won) and damages for delay calculated at the rate determined by the agreement from September 21, 2014, which is the following day of the above basic date, to the Plaintiff at KRW 21,238,036 of the remaining principal and interest of loans.

3. Thus, the plaintiff's claim against the defendants is justified.
