The prosecution of this case is dismissed.

1. The summary of the facts charged is that the Defendant is a person who is engaged in driving a B body-wide car.

On May 29, 2020, at around 14:25, the Defendant continued to run a road of D in front of D, which is located in Jeonju-gun C, Jeonju-gun, a three-lane from a post office room to a university room.

Since there is a road where a central line is installed, there was a duty of care to prevent accidents in advance by safely driving the motor vehicle without breaking the central line.

Nevertheless, the Defendant neglected to do so and received the front part of the G Russ car driven by the victim F (E.M. and 37 years old) who was frighting the central line at the front of the Defendant’s vehicle due to negligence to avoid an unclaimed vehicle parked at the front of the vehicle.

The Defendant suffered injury due to the above occupational negligence, such as the exposure of the victim’s detailed tear, which requires treatment for about six weeks.

2. The term "if a traffic accident gets involved in the median line of the road along which a lane is installed in violation of the former part of Article 3(2) proviso of the Act on Special Cases Concerning the Settlement of Traffic Accidents" means not the case where the point where the traffic accident occurred, but the case where a traffic accident gets into the median line without any inevitable reason, and the case where a traffic accident gets into the median line without any inevitable reason. The term "inevitable reason" in this context did not take other appropriate measures to avoid any obstacle on the lane.

It refers to the case where there are objective circumstances that make it impossible to criticize the driver in the Central Line itself, such as the driver has been invadedd due to external conditions that the driver cannot control, while intending to operate his/her own lane or to protect his/her own lane, and as long as the act of intrusion by the Central Line directly causes a traffic accident, the location of the accident is the place.
