1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. The following facts may be found either in dispute between the parties or in accordance with Gap evidence Nos. 1, 2, 4, and Eul evidence Nos. 1, 3, and 4, taking into account the whole purport of the pleadings:

The plaintiff is a corporation with the purpose of processing boxes, printing and processing paper products, etc.

B. The Defendant paid KRW 99,329,040 to C (representative D, hereinafter “C”) on six occasions from March 20, 2015 to September 2, 2015.

C. E (representative F; hereinafter “E”) issued a tax invoice of KRW 25,396,80 on April 6, 2015 and claimed payment of KRW 25,396,800 to the Defendant.

On April 30, 2015, the Plaintiff issued a tax invoice of KRW 25,289,605 and claimed payment of KRW 25,289,605 to the Defendant.

E. The Defendant paid KRW 25,396,800,000 to E on March 23, 2015, and KRW 25,396,80 on May 14, 2015.

2. Judgment on the plaintiff's claim

A. (1) The Defendant, who is in charge of the contract, is liable for the contract, to G’s packaging boxes of H (hereinafter “the instant product”).

The G granted the authority to act on behalf of the owner with respect to the production and supply of a million number of products, and the G requested for the manufacture of the instant product to C.

C A. The Plaintiff introduced the Plaintiff to G, and the Plaintiff intended to manufacture and supply the lower part of the packaging boxes among all the instant products. The Plaintiff produced 918,000 instant products and sent 500,000 goods to C at the request of G, and 418,000 goods to E, and supplied them to the Defendant. Accordingly, G delegated with the duties of manufacturing the instant products by the Defendant requested the Plaintiff to place an order for the instant product.

The Plaintiff received direct payments from C for 500,000 dividends from C.

G The transaction price with C shall be paid by C to the Plaintiff, and with respect to the remainder of 418,000, the Defendant shall be paid by issuing a tax invoice directly to the Defendant and receiving the payment from the Defendant.
