Defendant

A shall be punished by a fine of KRW 10,000,00, and by a fine of KRW 5,000,000, respectively.

The above fine is imposed against the Defendants.

Punishment of the crime

Defendant

A is a person who is established for the purpose of arranging domestic and foreign tourist services, etc. and works as the head of E’s sales promotional headquarters that opens a credit card merchant, and Defendant B is a person who works as the head of F’s accounting division in the name of “F” established for the purpose of tourist accommodation, etc.

1. An accused credit card merchant shall not make a transaction by credit cards in the name of another credit card merchant;

Nevertheless, around January 7, 2012, at the F Main Round located in Suwon-gu G, the Defendant B allowed the use of the said FF’s credit card merchant name from Defendant B, and then, the FF sales slip was prepared by settling KRW 23,200,000 with the credit card size in the said F’s name using the credit card of the customer seeking to purchase the chips in the said E using the credit card.

Defendant

A, including this, made a transaction by credit cards in the name of another credit card merchant in total amount of KRW 1,694,984,000 from January 7, 2012 to December 21, 2013 in the same manner as indicated in the attached list of crimes.

2. Defendant B shall not lend the name of the credit card merchant to another person;

Nevertheless, Defendant B allowed Defendant A to use the above FF’s credit card merchant name at the same date and time as in the preceding paragraph, and allowed Defendant A to prepare sales slips in the above F’s name as in the preceding paragraph.

Defendant

B, including this, lent a total of 184 times from January 7, 2012 to December 21, 2013 the credit card merchant name from January 7, 2012 to December 21, 2013.
