Punishment of the crime

A person who intends to divert farmland shall obtain permission from the Minister of Agriculture and Forestry.

The farmland located outside the agriculture promotion area is the farmland of 3,475 square meters (hereinafter referred to as the "land of this case") before Chuncheon-si.

1. Defendant A, without obtaining permission for diversion of farmland in around 2013, diverted farmland by performing the construction of underground water in order to carry out a 2,475m2 of the instant land as a distribution facility for fishery products, in a privately-owned fish shed, which is a distribution facility for fishery products.

2. Defendant B, without obtaining permission to convert farmland in around 2013, installed fences and containers to store equipment, vehicles, etc. necessary for the development and utilization of groundwater in the 1,000 square meters of the instant land.
