A defendant shall be punished by imprisonment for six months.

Punishment of the crime

The defendant has been engaged in the business of selling and collecting the molds of C, a company specializing in the manufacture of molds C, which is located in Chungcheongnam-si.

1. The Defendant supplied F with the amount of KRW 119,270,000,000, out of the total amount of KRW 80,200,00 from September 2012 to April 2013, 200, to F, operated by E in the Republic of Korea, Namyang-gun, and received KRW 39,070,00 from the total amount of KRW 80,200,00,000, out of the total amount of KRW 119,270,00.

On January 2014, the Defendant: (a) made a verbal promise to receive 17 ton of live kimchi 17 tons from E under the pretext of repayment for the payment of the red powder powder amounting to KRW 39,070,000, which was not paid by E as above; (b) around this time, sold 9.2 million won to G chain located in G Donyang-gun, after receiving four tons of live kimchi from E, and then sold 9.2 million won to G Donyang-gun; (c) from January 2014 to February 2, 2014, the Defendant received 9.2 million won of the sale price of the said kimchi from G chain and kept it for the victim without consent of the victim at that time.

2. On January 2014, in order to receive KRW 39,070,00,00 which was not supplied with red powder from the victim I, the representative director of H farming association, supplied 20 tons of lewdness and supply it to the defendant, the defendant sold 46,00,000 won (20 tons X 23,00,000 won per 20 tons Xkg) to the victim and delivered 26,00,000,000 won out of the above price to the defendant, and the remaining 2,00,000,000 won was supplied to the defendant under the name of the defendant (the victim at the time supplied it to the defendant and then supplied it to the defendant for 38,000,000 won of the above price, after being supplied to the defendant with red powder and then supplied it to the defendant for 30,000,000 won of the above price.
