Reasons
Punishment of the crime
【Criminal Power】 On February 20, 2018, the Defendant was sentenced to five years in the Changwon District Court to imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud), and the said judgment became final and conclusive on September 10, 2018.
【Criminal Facts】
1. Around December 2014, the Defendant, at the Changwon-si Hospital C located in Changwon-si B, stated that “The Defendant was punished by up to 3.8 billion won in real estate, so, was in operation of the convalescent hospital,” thereby making investments, and in inserting an apartment with construction cost of up to 1.5 million won, he/she may receive profits at a rate of up to 21 million won, depending on the market price after the three months, depending on which he/she entered the apartment construction, and then he/she may collect money from the victim D every three months thereafter, to the extent that he/she is 15 million won in total, and even if he/she is long, he/she may collect money from the victim D.”
However, the defendant did not have a specific plan to invest in apartment houses, and was thought to use the money received from the victim to operate the Evalescent.
Around December 30, 2014, the Defendant, by deceiving the victim, received KRW 50 million from the victim, to the F bank account under the name of the Defendant, and received KRW 2,429,100,000 from that time, from October 11, 2016, as shown in attached Table 1.
2. Around June 2015, the Defendant, at H frequency held in the vicinity of the Changwon-si, Changwon-si G, 2015, concluded that “The Defendant may earn profits from mass purchase through a person who wishes to enter the scam, thereby making profits from the purchase of the scam in a container. If I make an investment in scamboo in a lump sum before the scam, there may be a lot of money to bring in the scam at once. 30 million won. If an investment is made in an amount of KRW 10-15%, the Defendant may earn profits from 3 weeks to 10-15%.”
However, the defendant did not have a specific plan to invest in fishery products, and was thought to use the money received from the victim to operate the Evalescent.
