A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. On Oct. 206, 2006, the Defendant: (a) purchased Ilsan's Ba by investing half of the amount with the victim C on Oct. 1, 2006; and (b) agreed to sell 50 million won at the low price and divide profits among half of the amount; (c) prepared a total of KRW 182 million in the method of setting a deposit amount of KRW 82 million for the purchased real estate; and (d) purchased E-Ba 503 201 million in Goyang-gu, Goyang-gu, Young-si (hereinafter referred to as "all expenses").
On March 30, 2010, the Defendant sold the above real estate to F, received KRW 200 million from F, and embezzled KRW 59 million equivalent to the shares of the victim, which is 1/2 of the remainder except for deposit for the deposit for lease on a deposit basis, on the part of the victim, while on the part of the victim, the Defendant used the above real estate to repay the Defendant’s loan, pay interest, etc. at that time.
2. Fraudulent, fabrication of private documents, or uttering of private documents;
A. On December 201, 201, the Defendant: (a) received a request from G, the fifth degree of party accommodation, from G, to sell a house located in the construction work in the Gangnam-gun; (b) sold it to friendly job offering victim C; and (c) received the victim the difference by receiving the payment by falsely notifying the amount lower than the initial trading price requested from G.
Accordingly, on December 2, 2011, the Defendant told the victim at an insular location in the Seocho-si, 201, that “The Defendant was going through a telephone and tried to make a prompt disposition before the completion of construction, as it is necessary to pay money.” The Defendant said, “The trading price of KRW 300,000 per square meter and KRW 63,90,000 per square meter is KRW 213.”
However, in fact, the sales price of the above land determined in consultation with G was KRW 20 million per square, and KRW 42.6 million per actual sales price was the victim to pay to G, and KRW 21.3 million, the remainder of the difference, was the victim to have a street in the middle.
In this respect, the Defendant is as above.
