1. The Defendant’s KRW 17,047,318 among the Plaintiff and KRW 2,959,062 among the Plaintiff, shall be KRW 3,52,064 from December 16, 201.
Reasons
1. Basic facts
A. The Plaintiff is a co-owner of D Commercial Building Nos. 202, 309, and 316 (hereinafter “each of the instant stores”) located in Busan Northern-gu C and three parcels (hereinafter “instant commercial building”).
On November 10, 2009, the Defendant is a corporation that has been transferred with the operation authority under the consent of the sectional owners of the instant commercial building including the Plaintiff (hereinafter “instant sectional owners”) from E, a stock company with the original authority to operate the instant commercial building.
B. Around 2010, the instant sectional owners, including the Plaintiff delegated the power to execute the lease agreement with the Defendant on the instant commercial building, and delegated the authority to enter into a lease agreement with the Liland et al. (hereinafter “Liland”) with respect to the instant commercial building by preparing the following major written consent (hereinafter “instant consent”).
I confirm that the consent form is the legitimate owner of the store in the commercial building in this case, who is a legitimate owner of the store in this case and has been seeking measures to resolve the difficulties in the individual lease and operation of the building due to the limit of the aggregate building since the opening point, and agree to use the specialized distributor, lease the building in a lump sum, lease the 1st floor and the 6th floor above the commercial building in this case, including the entire exclusive use and common area owned by the principal, and lease the 1st floor above the commercial building in this case or the 6th floor above the building in this Ireland, etc., and that the defendant is appointed as the mandatory and
