A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On June 22, 2015, the Defendant: (a) called the victim C and elementary school dong, and (b) requested the victim to lend money to the victim for the purpose of selling bathing salt; (c) because of low credit rating, the Defendant requested the victim to provide a guarantee because it is necessary to provide a loan due to low credit rating; and (d) caused the victim to enter into a joint and several surety contract when the Defendant borrowed a total of KRW 15 million from the lending companies.

From July 17, 2015 to September 19, 201 of the same month, the Defendant got a telephone from the victim several times from the Busan (hereinafter referred to as Busan) to the end of the same month, and can get a loan of KRW 30 million,00,000,000,000 from the deposit in the passbook within the name of 30,000 won. On the other hand, if the Defendant borrowed KRW 60,000,000,000,000,0000,000 won, he/she shall have repaid the debt owed to the joint and several liability before the payment, and he/she shall receive additional loans of KRW 30,000,000 from the passbook within 30 months, and he/she shall receive additional loans of KRW 30,000,000,000,000,000,000 from the half of the same month.

However, in fact, the defendant extended money from the damaged party to the above 15 million won joint and several liability obligation. However, since most of the remainder of the borrowed money was scheduled to consume it under the name of the defendant's existing debt repayment and living expenses, the defendant did not have any intention to deposit it in the account in the name of the defendant for three months, as agreed by the defendant, he could not receive a loan of 60 million won after three months. Moreover, the house in which the defendant's mother resides in around August 29, 1999 of the defendant's father's father's father and the defendant's mother D is jointly inherited with the defendant's mother and the defendant's mother D.
