1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. Before the division, G was indicated in the Land Survey Book prepared during the Japanese colonial era as to the land of 1,851 square meters in the GF 1,851 square meters (hereinafter “land before division”).
B. He died on February 15, 1919 and succeeded to the property solely by the head of Si/Gun/Gu and the heir of Australia.
I died on July 17, 1940, and I died on November 3, 1931, and on February 20, 1929, KK, the south of J, also succeeded to I's property as Australia heir.
L was killed on October 16, 1962 and succeeded jointly to the property of the Plaintiff and the wife of the Australia, a family heir, but M was deceased on July 26, 201 and the Plaintiff, the inheritor, inherited the property of M solely, thereby having succeeded to all L’s property.
C. On January 5, 1965, N completed the registration of ownership preservation on the land before subdivision (hereinafter “registration of ownership preservation”), and died on November 29, 1976. On December 22, 1982, N, the Defendants, N’ heir, and other co-inheritors, such asO, P, Q, etc., on the ground of inheritance, the registration of ownership transfer was completed in the name of Defendant C as to the whole land before subdivision on the grounds of the renunciation of shares among the remaining co-inheritors except Defendant C on the same day.
On July 28, 1993, the land before subdivision was divided into 1,087 square meters and R 764 square meters, and the name of the said F 1,087 square meters was changed to 1,087 square meters according to the administrative district change. Defendant C transferred 527/100 of the above land to Defendant B on the ground of sale on June 27, 2003.
E. On July 2, 2003, the said D land was divided into the pertinent 527 square meters and E 560 square meters on the grounds of the division of common property. The said D land was registered in the name of the Defendant B, and the said E land was registered in the name of the Defendant C.
