1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. On June 10, 2014, Plaintiff B set and leased the first floor E (hereinafter “instant store”) of the building located in Gangnam-gu Seoul Metropolitan Government D (hereinafter “instant store”) 50 million won as the lease deposit, and from July 31, 2014 to July 31, 2016, Plaintiff B paid 48 million won as the premium to F, a lessee of the instant store, and Plaintiff A (hereinafter “Plaintiff”) after the said lease.
B. Afterwards, the Plaintiffs agreed to operate a restaurant instead of coffee shop in the instant store, and to operate the instant restaurant with the Defendant, who operated the restaurant in the Gangseo-si waterway around August 2014, in the instant store (hereinafter “instant restaurant”).
At the time, the plaintiffs and the defendant invested in the partnership fund by dividing them, and their management shall be the defendant, and 50% of their profits shall be the defendant, and the remaining amount shall be 25%, respectively.
C. From June 10, 2014 to July 31, 2014, the transfer date of the above business agreement, Plaintiff B paid KRW 60,697,390,000,000 for lease deposit and KRW 48 million for the instant store; KRW 716 million for brokerage commission; and Plaintiff A paid KRW 30,000,000 from June 25, 2014 to December 5, 2014 for the instant store’s premium; KRW 20,000,000 for operating funds of the instant restaurant; KRW 20,000,000 for the instant restaurant; and KRW 88,00,000 for rent around August 19, 2014; and the Defendant invested KRW 50,000 for construction expenses, which is the Plaintiff’s discount.
On January 12, 2015, the Plaintiffs and the Defendant prepared a general statement of accounts (No. 1) concerning the total amount of contributions and confirmed each other. According to the above statement of accounts, the funds required for the operation of the same business are 7,469,000 won (including value-added tax), rents, and public charges for the instant restaurant.
