1. The Defendant shall pay to the Plaintiff KRW 122,20,000 and the interest rate of KRW 15% per annum from November 2, 2011 to the date of full payment.
Reasons
1. According to the overall purport of evidence Nos. 1, 2, and 3-1 of evidence Nos. 1, 3-1 and the whole pleadings, the following facts are acknowledged ( although the defendant is based on the seal of the defendant, it is argued that C arbitrarily affixed the seal of the plaintiff without authority, it is forged. According to the evidence Nos. 5, 8-1, 2, 9, and 10 of evidence Nos. 8-1, 9, and 10 of evidence Nos. 8-1, 9, and 10 of witness D's testimony and the whole purport of pleading, the defendant delegated the preparation of the above agreement to E, who is the husband, and accordingly, it is recognized that E prepared the above agreement under the name of the defendant. Thus, the defendant's assertion is without merit).
On February 28, 1995, the Plaintiff completed the construction by entering into a contract with the Changho Construction Co., Ltd. (hereinafter referred to as the “National Land Construction”) from the Busan East-gu Construction Co., Ltd. (hereinafter referred to as the “instant construction”) for the cost of KRW 126,70 million.
B. On November 2, 2011, the Plaintiff: (a) issued a provisional attachment order for real estate owned by the construction of the national land with the claim claim amounting to KRW 1270,000,000,000 as the Busan District Court Branch Branch of Busan District Court Decision 201Kadan3606; and (b) executed the said provisional attachment order with the claim amounting to KRW 126,77
(hereinafter referred to as “instant provisional attachment order”). C.
Since then, the Plaintiff filed a lawsuit against the construction of the land in Busan District Court as Busan District Court Branch Branch 2012Gahap531, claiming payment of KRW 172,2200,000,000,000,000,000,000,000,000,000,0000,000,000,000,000,000,000,000,000,000,000,000
(hereinafter “instant judgment”) D.
The construction of national land shall be conducted on March 12, 2013 to raise funds for the security of the real estate, such as those set forth in the preceding sub-paragraph.
