Defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

1. 아동ㆍ청소년의성보호에관한법률위반(성매수등) 피고인은 2019. 6. 17. 03:00경 부산 서구 B건물, C호에서 스마트폰 채팅앱 ‘앙챗’을 통해 만난 청소년인 D(여, 16세)과 15만원에 성관계를 하기로 약속하고 만나 위 D과 성교행위를 한 후, 117,000원 상당의 담배를 위 D에게 건네주어 아동ㆍ청소년의 성을 사는 행위를 하였다.

2. 아동ㆍ청소년의성보호에관한법률위반(강간) 피고인은 2019. 6. 30. 11:00경 제1항 기재 장소에서 청소년인 피해자 D(여, 16세)과 스마트폰 채팅앱 ‘앙챗’을 통해 15만원에 성관계를 하기로 약속하고 만났으나, 10만원만 받고 성관계를 하자는 피고인의 요구를 피해자가 거부하자 손으로 피해자의 어깨를 밀어 바닥에 눕히려 하고 피해자의 상의 속옷을 벗긴 후 가슴과 음부 부위를 만지는 등 피해자의 반항을 억압하고 강간하려 하였으나 피해자가 밀치는 등 저항하자 그 뜻을 이루지 못하고 미수에 그쳤다.
