Defendants shall be punished by a fine of KRW 2,000,000.
In the event that the Defendants did not pay the above fine, each of them is 100.
Reasons
Punishment of the crime
Defendant
A is a person who engages in the repair business of ships under the trade name of "D" in the Yeongdeungpo-gu Busan Metropolitan City.
1. Article 37 (3) of the Act on the Arrival, Departure, etc. of Ships where a ship of 20 gross tonnage or more is repaired outside a danger zone by means of flames or heat-generating outside a danger zone: The captain of a ship shall report to the Minister of Oceans and Fisheries on the ship, as prescribed by Ordinance of the Ministry of Oceans and Fisheries, where the ship of 20 gross tonnage or more is to be repaired outside a danger zone by means of a incombustible, flames or heat-generating outside a danger zone;
In accordance with this, the Ministry of Oceans and Fisheries shall report to the Minister of the Ministry of Oceans and Fisheries, and the submission of work plans and related certificates shall be mandatory to ensure the safety of work.
Defendant
A around June 2015, at the above D office, submitted to the Busan Regional Maritime Affairs and Fisheries Office on June 6, 2015 the F. F. S. P. P. P. F. P. P. F. P. F. F. F. F. F. F. F. F. F. F. F. F. F. F. D. removal and disposal of the deck.
From that time until April 7, 2016, the Defendant borrowed another person’s national technical qualification certificate through the foregoing eight times in total, as shown in the list of offenses in the attached Form.
2. Defendant B lent the Defendant’s above-mentioned qualification certificate to Defendant A on the date and at the same time and at the place set forth in the preceding paragraph, and extended the national technical qualification certificate on eight occasions in total, as shown in the list of crimes in the attached Table, until April 7, 2016, as well as from April 7, 2016.
