A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant, in violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (a minor indecent act by force) committed an indecent act by force against a victim under 13 years of age by visiting the victim D (in such cases, 12 years of age) home located in Ansan-si, Ansan-si, as a visiting teacher at the time of the end of December 201, in a manner that they are going to a school with the victim, going out of the bridge while opening a school with the victim.

2. Violation of the Act on the Protection of Children and Juveniles against Sexual Abuse;

Around January 2013, the Defendant: (a) visited the victim D (Inn, 13 years of age) home located in Ansan-gu, Ansan-si E as a visiting teacher; (b) visited the victim as his/her breast at the victim’s home; (c) seated the victim’s breast; and (d) committed an indecent act by force against the juvenile by inserting his/her finger into the victim’s panty line with his/her finger line.

C. Around February 2013, the Defendant: (a) visited the victim D (Inn, 13 years of age) home located in Ansan-si, Ansan-si; (b) visited the victim as a visiting teacher; and (c) opened the victim with him/her, he/she met the victim’s chest, and (d) committed an indecent act by forcing the juvenile, by inserting his/her finger into the victim’s panty line, and making him/her talk with him/her.

On February 23, 2013, the Defendant visited the victim F (V, age 15) house E in Ansan-si, Ansan-si, as a visiting teacher, and was seated later than the victim while rendering a lessons with the victim.
