1. The plaintiff shall be entitled to the following amount among the parts against the defendant around the judgment of the court of first instance.

1. Basic facts

A. The parties’ relationship 1) Defendant B Co., Ltd. (hereinafter “Defendant B”).

(1) The Defendant C is the representative director of the Defendant B, and Defendant C is the company that runs the business of importing and selling scam and its surrounding articles. Defendant B is the building listed in the attached Table 1, which is the Defendant C’s ownership (hereinafter “instant warehouse”).

(2) The Plaintiff is a person operating a business with the trade name of “Elaundry” in the building located in Gangseo-si, which is the neighboring building of the instant warehouse.

B. (1) On November 20, 2013, at around 05:37, a fire occurred in the instant warehouse possessed by Defendant B, and the instant warehouse was removed, and the occurrence of an accident to be burned off to the 4th building, including the building located in Gangnam-si, Yne-si, and three cars parked in its neighboring areas (hereinafter “the instant fire accident”).

(2) On the same day, a fire-fighting vehicle reported by a person who was nearby the instant fire immediately after the occurrence of the instant accident arrives at the site around 05:42 on the same day, success in the initial extinguishing of the fire around 07:01 on the same day, and the fire was completely extinguishing around 08:01 on the same day.

3) Due to the instant fire accident, the Elaundry signboard operated by the Plaintiff was destroyed by the fire accident. C. On the part of the fire site, the investigation of the instant fire accident revealed as follows in relation to the said fire accident, and finally concluded that “the fire fighting unit, the fire fighting source, the first cargo, the fire fighting-related equipment, the products, and the power source are each US parts, and the spread of the burning object is styp and the cause of spreading the burning substance is a sudden combustion of inflammable substance.”

Fire is presumed to have been burned around the exhibition room in B. Fire is likely to be a fire: according to the result of internal investigation by the head of the Gangnam Police Station below the outside in the place of fire occurrence, the fire is presumed to have been burned around the exhibition room.
