1. The defendant, the plaintiff A, the real estate in attached Form 1, the real estate in attached Form 2 to the plaintiff B, and the plaintiff C.
Reasons
1. Basic facts
A. On August 2, 2017, the Defendant leased the real estate listed in attached Form No. 1 (hereinafter “instant store”) from Plaintiff A, the real estate listed in attached Form No. 2 (hereinafter “instant store”) from Plaintiff B, the real estate listed in attached Form No. 3 (hereinafter “instant third store”) from Plaintiff C and D, and the real estate listed in attached Form No. 5 (hereinafter “instant fifth store”) from Plaintiff F as follows. On September 25, 2017, the Defendant leased the real estate listed in attached Form No. 4 (hereinafter “instant four store”) from Plaintiff E, and the real estate listed in attached Form No. 6 (hereinafter “instant store”) from Plaintiff G with each of the following contents:
(hereinafter referred to as "each of the instant lease agreements"): Deposit: KRW 20 million per month: KRW 1650,000 per month (including value-added tax of KRW 150,000), prepaid, and the period of lease from rent until three months after the date of commencement of the business of the Defendant: 120 months from the date of delivery;
B. On August 20, 2017, Plaintiff B transferred the instant store No. 2; Plaintiff F sent the instant store No. 5 on September 26, 2017; and the rest of the Plaintiffs delivered the instant store No. 1, 3, 4, and 6 on September 27, 2017, respectively.
C. On September 27, 2017, the Defendant commenced marina business at the stores Nos. 1 through 6 of this case.
On December 27, 2017, the following day of the period of exemption from rent, the Defendant paid all the rents to the Plaintiffs from January 26, 2018 to January 26, 2018 (hereinafter referred to as December and the same applies even after the following month). The Defendant paid all the rents from January 2018 to May 2018 as indicated below.
However, on September 19, 2018, the Defendant paid 6.6 million won for each of the plaintiffs from June 2018 to September 2018 (i.e., KRW 1.650,000 x 4 months) to the plaintiffs, and did not pay the remainder.
The plaintiff monthly is entitled to the payment of rent.
