Defendant shall be punished by a fine of KRW 4,000,000.
If the defendant does not pay the above fine, 50,000 won.
Reasons
Punishment of the crime
1. The Government shall not photograph the body of another person against his/her will, or distribute, sell, lease, provide, or openly display or show any photographed object in contravention of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (hereinafter referred to as "camer, etc.") or any other similar mechanism or device;
A. From June 8, 2013 to June 21:44, 2013, the Defendant: (a) taken the body of the victim C (n, 27 years of age) who was a cleaning agent after having opened a toilet for the B-house in Yongcheon-si, B-si; and (b) taken the body of the victim C (n, 27 years of age) by using his mobile phone camera image function.
Accordingly, the Defendant taken the body of another person, who could cause sexual humiliation or shame, using a camera or other similar mechanism, against his will.
B. On June 24, 2013, the Defendant committed a crime on June 24, 2013: (a) around 17:22, the Defendant tried to convert his/her cell phone camera from the toilet screener No. 508, 106, Young-si D Building No. 508, to screen another person’s body by installing a video camera; and (b) the cell phone did not take a photograph away from the toilet floor.
Accordingly, the Defendant tried to take, but attempted to take, another person’s body, which may cause sexual humiliation or shame, against his will, using a camera or other similar mechanism.
2. On June 24, 2013, around 17:22 on June 24, 2013, the Defendant entered the house via the opening entrance without obtaining permission from the victim E (in women, 38 years old) of the D Building No. 508 106, Young-si.
Accordingly, the defendant invadedd the victim's residence.
