A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant issued a summary order of KRW 2,50,000 on September 2, 2011 to a fine of KRW 3,50,000 for the same crime in the original state support of the Chuncheon District Court on April 21, 2004.

[Criminal facts]

1. On November 5, 2017, the Defendant, while under the influence of alcohol at around 20:40, the Defendant driven CM5 car from the parking lot for the original state sbro sbroto hospital located in 20 in the Hanju-si, Hanju-si, Nowon-si, to the ordinary distance intersection located in 162 at the center of the same city from the parking lot for the original state sbro sbrototop. 3 to the ordinary distance of 1k meters at the center of the same city.

2. The Defendant is a person engaging in driving a MF5 vehicle as stipulated in the above paragraph (1).

On November 5, 2017, at around 20:40, the Defendant driven the said car while under the influence of alcohol as set forth in paragraph (1) of the above above, and proceeded from the center of the city of Won-si to the screen of the new interest industry.

Since there is an intersection in which signal apparatus is installed at the front, there was a duty of care to check the signal to a person engaged in driving of a motor vehicle and prevent the accident by driving the motor vehicle safely in accordance with the signals.

Nevertheless, the Defendant neglected this and went through the intersection as it is due to the occupational negligence of entering the intersection in contravention of the red stop signal, and received the part prior to the driving seat of the victim D(W, 49 years old) driving car driving in the direction of the original line from the off-distance off of the original line to the back of the original line.

Ultimately, the Defendant driven a motor vehicle in a situation where normal driving is difficult due to influence of drinking, and suffered injury, such as salt dynasium, tension, etc., which requires approximately four weeks of medical treatment to the victim.
