1. Basic facts

가. 소외 A는 2011. 9. 10. 오전경 부산에서 그 소유의 B 산타페 승용차량(이하 ‘원고차량’이라고만 한다)에 처 C, 모 D 2명을 태우고 위 차량을 운전하여 편도 2차로인 3번 국도를 산청군 생초면 방면에서 함양군 오부면 방면으로 1차로로 진행하던 중 같은 날 11:30경 산청군 오부면 양촌리에 있는 오부면 진입로 500미터 앞 도로에 이르러 마침 앞서 1차로로 진행하고 있던 번호 불상의 마티즈 승용차량을 피해 2차로로 차선 변경을 하다가 위 차량이 비가 내린 도로에 미끄러지면서 진행방향 우측에 설치된 가드레일을 충격함으로써 가드레일 지주 기둥이 뽑혀지고 가드레일이 휘어지면서 넘어져 가드레일을 타고 넘어가 5미터 높이의 언덕 아래로 굴러 위 지점 아래에 설치되어 있던 지하통로 시멘트 옹벽을 들이받고 튕겨져 전복되는 사고(이하 ‘이 사건 사고’라고만 한다)가 발생하였고, 이로 인하여 위 A, C, D은 모두 사망하였다.

B. The Plaintiff is an insurer who entered into a comprehensive motor vehicle insurance contract with A during the period including the date of the instant accident with respect to the said Plaintiff and A. By December 30, 201, the Plaintiff paid KRW 50 million to A with the insurance proceeds of the instant accident, KRW 133,120,740, KRW 530, KRW 5300, KRW 236,284,530, KRW 530, KRW 133,120, KRW 740, KRW 53,000 (= KRW 133,120, KRW 53,163,740, KRW 5363,790) to E’s heir. By December 30, 2011, the Plaintiff paid the insurance proceeds of KRW 1,468,00 to D repair expenses of the said location of the said accident (= KRW 1,468,00, KRW 468,00, KRW 2363830).

C. The Defendant is the construction and manager of the national highway No. 3 in which the instant accident occurred.
