1. Defendant B among the distribution schedule prepared on October 27, 2015 by the said court with respect to the distribution procedure case of Changwon District Court D.
Reasons
1. Basic facts
A. The designated parties including the Plaintiff (Appointeds) performed part of the construction with respect to the “F Sea Restoration Works in the Haak-gun, Haak-dong, Chungcheongnam-dong, Seoul-dong,” which was executed by the construction company of Soak-dong. Accordingly, the Plaintiff (Appointeds) was paid KRW 23,690,773, 9508,821; KRW 11,886,027; KRW 6,051,068; KRW 6,582,826; KRW 3,805,478; KRW 8,104,109; KRW 7,965,054; and KRW 7,96,054; and KRW 407,00,000; KRW 407,000; and KRW 47,000.
B. A In respect of the securities in which Soci comprehensive Construction made an investment.
The distribution procedure was conducted in accordance with the procedure of selling investment certificates, as described in the subsection (D) and the plaintiff (appointed party) and the designated parties (hereinafter collectively referred to as the "Plaintiff") will be the case of the establishment of the Suduk Integrated Construction.
As the execution creditor specified in the claim, the defendant Republic of Korea is the execution creditor who has the claim for the amount of national tax in arrears against the sub-joint construction of sub-dune comprehensive construction, and the defendant B and C is the execution creditor who has the claim for the amount of national tax in arrears.
C. The distribution court determines the amount to be actually distributed on October 27, 2015 as KRW 58,084,29,295 and distributes to the Defendant Republic of Korea (hereinafter “instant distribution schedule”) the amount to be distributed to each of the Defendant’s dividends of KRW 36,459,260 (100%) among the dividends, 13,472,845 won (62.30%) to the Plaintiff, to the second priority (owner of attachment), to the Defendant B (2), to KRW 4,520,925 (20.906%) to the second priority (the provisional attachment authority), to the Defendant C, to the second priority (2) (3,631,265 won (the dividend ratio) (16.792%).
