1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The Plaintiff’s cause of the Plaintiff asserts that, from July 25, 2008 to April 1, 2013, the Plaintiff leased KRW 223,690,000 to the Defendant, because the Plaintiff agreed to transfer money to a bank account in the name of the Defendant or a bank account in the name of a de facto marital relationship with the Defendant over several occasions or to receive interest calculated at the rate of 30% per annum by issuing a check to the Defendant, the Defendant is obligated to repay the above borrowed money to the Plaintiff.
2. 판단 살피건대, 갑 제1 내지 6호증의 각 기재에 의하면, 원고가 피고 명의의 농협중앙회 계좌로 2008. 7. 25. 800,000원을, 2008. 10. 31. 1,000,000원을, 2009. 12. 7. 740,000원을, 2009. 12. 9. 4,750,000원을, 2012. 3. 16. 10,000,000원을 각 송금한 사실, 원고가 2009. 9. 11. 원고 명의의 농협중앙회 계좌에서 30,000,000원을 인출한 사실, 원고가 2011. 10. 5. 39,000,000원을 인출하거나 타인에게 송금한 사실, 원고가 피고 명의의 은행 계좌로 2008. 8. 25. 3,000,000원을, 2008. 11. 6. 5,001,500원을, 2009. 2. 2. 2,001,500원을, 2009. 6. 1. 700,000원을, 2009. 6. 18. 6,001,500원 및 3,201,500원을, 2010. 9. 28. 501,300원을, 2010. 12. 15. 5,000,000원을, 2011. 10. 17. 510,000원을, 2011. 11. 11. 5,000,000원 및 5,000,000원을, 2012. 7. 12. 6,000,000원, 6,000,000원, 6,000,000원 및 1,000,000원을, 2012. 8. 20. 1,000,900원을, 2012. 8. 21. 1,700,900원을, 2012. 12. 21. 1,050,000원을, 2013. 3. 26. 6,000,000원 및 2,000,000원을, 2013. 4. 1. 6,000,000원 및 6,000,000원을, D 명의의 은행 계좌로 2009. 11. 2. 5,001,500원 및 5,001,500원을, 2009. 12. 21. 4,001,500원 및 3,001,500원을, C 명의의 은행 계좌로 2011. 11. 1. 5,001,300원 및 5,001,300원을, 2013. 1. 15. 20,000,000원을 각 송금한 사실, 원고가 피고로부터 2009. 8. 28. 130,000원 및 1,200,000원을, C으로부터 2009. 9. 2. 600,000원을 원고 명의의 은행 계좌로 각 송금받은 사실은 인정된다.
