Reasons
Punishment of the crime
The defendant is a person who has retired from office in D around 2015 as a member of the Co., Ltd. (State).
A. On September 28, 2017, around 18:50 around September 28, 2017, a copy of the labor-management council on March 3/4, 2017 was invaded into D factories and the first floor resting room located in Daejeon Seo-gu, Daejeon.
B. On September 28, 2017, around 18:50, a theft entered the building of the main office of the foregoing D factory using a certificate of access received at the guard room when filing a report on entry in the guard room, and posted it on the bulletin board of the first floor.
In March 2017, it was stolen by putting a copy of the labor-management council in March 2017.

As to the Defendant’s report of investigation (on-site dispatch) and his defense counsel’s assertion, the Defendant alleged that the Defendant was an outside person who retired from employment in D, and that the Defendant entered D resting room with the permission of the security guards belonging to D, and that the security guards entered D resting room by normal means. However, if the Defendant informed G of the initial purpose of entry, such as the theft of the records of the labor-management conference, he was only allowed to access by G, G stated that the Defendant allowed access to the Defendant, while the Defendant expressed the purpose of entry that the Defendant was leaving his seat, and it was not revealed that there was a person who decided that the Defendant was going to leave the resting room, and that there was a right to peruse or take the contents of the records of the labor-management council kept in another company resting room without permission.
It is difficult to see that the defendant's act is against the victim's will, however, brought out the register of the labor-management council which requires the approval of the company kept in the room for disclosure or perusal to D employees who will not be leaked to the competitor. In light of the circumstances in which the victim company discovered it immediately led to the 112 reported measures. Thus, the defendant's act is against the victim's will.
