1. The Plaintiff shall own 400 square meters prior to Seocho-gu Seoul Metropolitan Government, and the Plaintiff shall own 202 square meters prior to the foregoing D and 159 square meters prior to the foregoing E.
Reasons
1. In full view of the purport of Gap evidence No. 1-3 of the co-owned property partition claim, and the purport of all the arguments, the plaintiff shares 2/3 shares, and the defendant shares 1/3 shares, respectively, and the defendant shares 1/3 shares, respectively, in the Seocho-gu Seoul Metropolitan Government D's 202 square meters, C40 square meters, and E's 159 square meters (hereinafter "the land of this case") prior to D's 202 square meters, and the whole purport of the pleadings. The plaintiff wishes to divide by the value compensation method, and the defendant only presents the opposing opinion as to the method of division desired by the plaintiff, and there is no counter-proof, and the defendant does not present any opinion as to the appropriate method of partition. According to the above facts, according to the above facts, the plaintiff can claim the division of co-owned property
2. Method of partition;
A. As a lawsuit for partition of co-owned property, it is recognized that it is reasonable to acquire the co-owned property to a specific person, in full view of the circumstances such as the cause of the co-owned relation, the economic value of the co-owned share, and the desire of the co-owner as to the method of exchange of shares between co-owners or sale thereof, and that the co-owner's co-owned relation is resolved. Thus, the court does not intend to seek a co-owned property but make a reasonable partition according to the co-owner's share ratio according to free and discretion depending on the situation of the co-owned relation or the object which is the co-owned property (see, e.g., Supreme Court Decisions 93Da27819, Dec. 7, 1993; 97Da18219, Sept. 9, 197). If it is recognized that acquiring the price from another co-owner does not interfere with the substantial fairness between the co-owners.
