The defendant shall be innocent.

1. Around June 16, 2004, around 07:22, the Defendant violated the restrictions on the operation of vehicles by road management authorities by failing to comply with a request of a road management authority for the measurement of load on the Defendant’s business while the Defendant’s employee was operating a freight B vehicle owned by the Defendant in relation to the Defendant’s business.

2. The penal provisions applicable to the judgment subject to a retrial have retroactively lost effect according to the Constitutional Court’s decision of unconstitutionality, and thus, the Defendant is acquitted under the former part of Article 325 of the Criminal Procedure Act.
