1. 공소사실 피고인은 2019. 3. 1. 18:40경 불상의 장소에서 컴퓨터를 이용하여 온라인 게임 ‘B’ 채팅창에 닉네임 'C'으로 접속하여, 피해자가 소속된 길드인 ‘D’의 길드원 여러 명이 보고 있는 가운데, 닉네임 ‘E'로 접속한 피해자 F과 채팅으로 언쟁을 벌이던 중 피해자에게 “응 니엄마는 챙련(창녀)임”, “니 엄마 에이즈 걸렸으니 봐달라고 호소하는거야 ”, “니 엄마는 챙련임 ㅋㅋ”, “응 에이ma(애미) 챙련”, “니 엄마랑 G이(닉네임 ’H‘로 접속한 다른 길드원 지칭) 아빠랑 잭스(섹스)하고 있드라”, “고소장 쓰고 있었는데 bs련이(병신년이)”, “지적 장애련”이라고 채팅글을 작성하여 공연히 피해자를 모욕하였다.

2. The facts charged of this case are crimes falling under Article 311 of the Criminal Act, which can be prosecuted only when a complaint is filed under Article 312(1) of the Criminal Act. According to the records, it can be acknowledged that the victim revoked the complaint against the defendant around February 25, 2020 after the prosecution of this case was instituted. Thus, the prosecution of this case is dismissed in accordance with Article 327(5) of the Criminal Procedure Act.
