1. Basic facts

가. 별지 목록 기재 부동산의 소유자들인 원고들은 2017. 4. 15. 피고 C과 사이에 별지 목록 기재 부동산 중 5층 사무실 부분을 임대차보증금 1,000만 원, 차임 월 110만 원, 임대차기간 2017. 4. 30.부터 2019. 4. 30.까지 각 정하여 임대하는 내용의 계약을 체결하고 그 무렵 위 피고에게 위 부동산 5층 중 별지 도면 표시 ㉮, ㉯, ㉳, ㉴, ㉮의 각 점을 차례로 연결한 선내 (갑) 부분 80.73㎡(이하 ‘이 사건 점유 부분’)를 인도하여 주었다.

B. On September 10, 2017, with the consent of the plaintiffs on September 10, 2017, the defendant C sub-leaseed the object of the lease to the defendant D with the amount of KRW 3 million as the sublease deposit, KRW 400,000 per month, and the sublease period from September 10, 2017, and then transferred the said leased object.

C. Defendant C paid only the rent to the Plaintiffs until August 30, 2017, and did not pay the rent thereafter.

On May 21, 2018, the Plaintiffs notified the Defendants of the termination of the contract based on Article 4 of the instant lease agreement, which provides that the lease contract may be terminated at a time of default of rent at least three times, and the said notification reached the Defendants around that time.

2. Claim against Defendant C (hereinafter “Defendant”)

A. According to the above facts as to the cause of the claim, the lease contract of this case was legally resolved by the plaintiffs' notice of termination on the ground of the defendant's delinquency in rent.

Therefore, the defendant delivers to the plaintiffs the occupied part of this case, which is the leased object, and 1.1 million won per month from September 1, 2017 to the completion date of the above delivery.
