그런데 위 피해자가 엎드려 있던 곳은 딱딱한 시멘트 골조 바닥이었고 이러한 바닥에 위 피해자가 얼굴부위가 근접한 상태로 엎드려 있었으므로 금속성 물질의 반토막난 대걸래 자루를 위 피해자가 엎드려 있는 바닥을 향해 집어 던질 경우 바닥에 튕겨지게 되면서 사고발생의 위험이 있으므로 미연에 사고 발생을 방지해야 할 주의의무가 있었다.

그럼에도 불구하고 피고인은 이를 게을리한 채 손에 들고 있던 반토막 대걸레 자루를 위 피해자가 엎드려 있던 곳 바닥을 향해 강하게 집어 던져버려 바닥에 튕겨진 반토막 대걸레 자루가 위 피해자의 우측 안구 주변을 가격하게 되었다.
