2. The costs of lawsuit shall be borne by the Plaintiff.

A. The Plaintiff is the owner of the following real estate:

A. The Plaintiff’s assertion is that the Plaintiff owns a house on the ground owned by the Plaintiff, and ① the land owned by the Plaintiff is surrounded by land owned by another person, including the land owned by the Defendant.

원고는 피고 소유 토지 중 별지 도면 1 표시 1, 2, 3, 4, 5, 6, 1의 각 점을 차례로 연결한 선내 ㈎부분 60㎡(이하 ‘이 사건 ㈎부분’이라 한다)를 원고 소유 ①토지로부터 공로로 출입하기 위한 통행로로 사용해오고 있었다.

그런데 피고가 이 사건 ㈎부분에 막대를 박고 철망을 설치하는 등으로 원고의 통행을 방해하고 있다.

원고는 피고를 상대로 이 사건 ㈎부분에 대한 주위토지통행권의 확인, 막대와 철망의 철거, 통행방해행위의 금지를 구한다.
