2. The costs of the lawsuit are assessed against the defendant.

The plaintiff is composed of two students and two households, and the plaintiff has received basic old age pension in accordance with the Basic Old Age Pension Act every month since 2008.

As a result of the fact that the financial property of the Plaintiff’s husband and wife increased to KRW 328,035,00 from KRW 138,530 to July 1, 2014 (= KRW 327,628,00, KRW 327,628,000), the Defendant determined that the amount of income of the Plaintiff’s husband and wife of KRW 1,469,751 (= monthly income conversion of KRW 181,180 per month, monthly income of KRW 181,182, KRW 1,283,479, and KRW 209, KRW 200, KRW 324,000, KRW 327,000 (= KRW 427,628,00) of the Plaintiff’s financial property increased to KRW 1,469, KRW 180, KRW 180, KRW 183,479, and KRW 204, etc. of the basic pension amount (hereinafter referred to be determined).

Accordingly, on July 9, 2014, the Defendant provided the Plaintiff with a prior guidance on the change of eligibility for a welfare beneficiary to the effect that “as a result of an investigation into the Plaintiff’s household, it is anticipated that the suspension of eligibility for a basic pension will be expected due to the change of financial property,” and did not pay a basic pension to the Plaintiff from July 25, 2014 (hereinafter “instant site wage determination”), but did not separately notify the Plaintiff in writing of the change of entitlement to a basic pension (hereinafter “instant site wage determination”).

The Plaintiff filed an objection to the suspension of payment of a basic pension on July 31, 2014, but the Defendant rejected it on August 25, 2014.

On December 8, 2014, the Plaintiff applied for the payment of a basic pension to the Defendant, and the Defendant, as a result of the investigation on January 12, 2015, the recognized amount of income of the Plaintiff’s husband and wife is calculated as the criteria for the selection of the recipient of a basic pension and recognized amount of income
