The defendant is not guilty. The summary of the judgment against the defendant shall be published.
1. The summary of the facts charged is that the Defendant had a seal imprinted by C, who is the husband, issued a certificate of the personal seal imprinted by C, and had a joint and several surety established under his name to lend money in the name of the Defendant.
1. The crime committed on September 20, 2012;
A. On September 20, 2012, the Defendant: (a) stated “A” and “C” in the “A” column on the proxy form for the issuance of a certificate of personal seal impression kept at the E community service center located in Nowon-gu, Nowon-gu; (b) stated “A” and “C” on the letter of proxy for the issuance of the certificate of personal seal impression; and (c) affixed C’s seal that he/she had in advance in his/her name.
Accordingly, for the purpose of uttering, the Defendant forged a letter of delegation in the name of C, which is a private document on rights and obligations, and issued a forged letter of delegation to a public official who is aware of such forgery on the same form and exercised it as if it was duly formed.
B. On the same day, the Defendant forged a letter of delegation to prepare a notarial deed and exercised the same day, stating “A” and “C” in the “Mandatary” column in the letter of proxy to prepare a notarial deed kept in the “Law Firm G” located in “Y” in “A” and “A” column, and stamped C’s seal that he/she had in advance subsequent to C’s name.
As a result, the Defendant forged a letter of delegation in the name of C, which is a private document on rights and obligations, for the purpose of uttering, and exercised the forged power of attorney H and I belonging to the above law firm, who knew of the forgery, as above, as if it had been duly formed.
C. On the same day, the Defendant submitted to H and I an attorney-at-law who is a notary public and a certificate of the personal seal impression as above in the above law firm as of the same day, and the above H and I knew of such fact. The Defendant is from J.
