Basic Facts
The deceased D(the deceased on January 6, 2006, hereinafter referred to as the “the deceased”) had the defendant, the defendant, the plaintiff A, the plaintiff B, the defendant F (the name G), the third party H, and the third party I between the defendant, the spouse, and the defendant, the plaintiff B, the son F (the name G), the third party H.
On July 1, 1957, the Deceased purchased 192.74/1430 shares (hereinafter “instant land”) from the Republic of Korea on July 1, 1957 from the Republic of Korea, and completed the registration of ownership transfer on July 23, 1957. On July 6, 1963, the Deceased completed the registration of ownership transfer on the ground of sale as of May 6, 1961.
On April 3, 1973, the Defendant completed the registration of ownership transfer on the ground of the contribution from January 15, 1973 to the school juristic person K established by the Deceased on April 3, 1973, and completed the registration of ownership transfer on the ground of the cancellation of the contribution contract from June 30, 1989.
The instant land was divided into L, M, and N around that time, and the Defendant completed the registration of ownership transfer as to L and M’s land by reason of the partition of co-owned property on August 27, 1991, and completed the registration of ownership transfer as to J and N’s shares in the Seoul Special Metropolitan City.
Meanwhile, the land of this case was determined and publicly announced as a redevelopment area under the former Urban Redevelopment Act (amended by Act No. 6825, Dec. 30, 2002; hereinafter the same) on September 21, 1979, and the execution authorization and authorization of the redevelopment association were granted on December 23, 1986. The management and disposal plan was approved and publicly announced on August 30, 2003. The land of this case and the N land of this case under the name of the defendant remaining after the division was finally incorporated into the above redevelopment project area, and the defendant completed the registration of preservation of ownership by selling each real estate listed in the attached Table (hereinafter referred to as the "water-sale real estate of this case") on July 22, 2009.
On June 7, 2012, E and children F of the deceased, H and the Defendant filed a lawsuit claiming the agreed amount against the Seoul Central District Court 2012Gahap47710.
