On June 8, 2012, the Plaintiff entered into a contract with the Defendant on June 8, 2012, under which the Plaintiff shall newly construct a 4-story building on the land of Suwon-si, Suwon-si, 216.7 square meters, which is owned by the Defendant, until October 31, 2012, and the Defendant shall pay the construction cost of KRW 400 million (A evidence 1; hereinafter “instant contract”).

At the time of the conclusion of the instant contract, the original Defendant agreed on the contents other than drawings, but did not have any additional amount in addition to the agreed terms. On the other hand, unlike the contents of the initial construction permit, the said building was to be newly built by dividing the said building into five households, studio three households, and 1 commercial buildings, and among which, the studio construction was agreed after the completion of the building.

The defendant, on June 9, 2012, KRW 100,000,000 for the plaintiff, KRW 22,000,000 for the same year.

5. 4. The Plaintiff was prepared and delivered a notarial deed based on a monetary loan worth KRW 40 million. On November 7, 2012, the Plaintiff’s claim for construction price against the Defendant as the obligor, and the Defendant as the third obligor is Suwon District Court 2012TTB4024.
