Reasons

1. The Plaintiff and the Defendant owned 1/2 shares of the real estate stated in the Disposition No. 1. Since the agreement on division was not reached and the survey was impossible due to topographical factors, it is difficult to divide the real estate in kind. Thus, the Plaintiff and the Defendant filed a claim for the division of the common property by the method of payment.
