피고인은 C 포터Ⅱ 화물차의 운전 업무에 종사하는 사람으로, 2015. 5. 3. 20:52경 혈중알콜농도 0.130%의 술에 취한 상태로 위 화물차를 운전하여 거제시 수월2길에 있는 수협 앞 도로를 거제보건소 쪽에서 수월초등학교 쪽으로 편도 2차로 도로의 1차로를 따라 시속 40km의 속도로 우회전하던 중 술에 취하여 조향장치를 제대로 작동하지 못하고 중앙선을 침범한 과실로 마주오던 피해자 D(42세) 운전의 E 쏘렌토 승용차의 좌측 앞 범퍼 부분을 위 화물차의 앞 부분으로 들이받아 그 충격으로 위 쏘렌토 승용차가 앞으로 튕겨 나가 그곳 길가에 주차되어 있던 피해자 F 소유의 G 스타렉스 승합차의 좌측 뒷 부분을 위 쏘렌토 차량 좌측 앞 범퍼 부분으로 충격하게 하였다.
