1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
On May 9, 2019, the Defendant, while proceeding in the instant lawsuit, cancelled the registration of the establishment of a new mortgage (Evidence No. 1) and no longer has a legal interest in seeking the cancellation of the registration of the establishment of a new mortgage (Evidence No. 1).
(Supreme Court Decision 201Da37001 Decided April 26, 2013). If so, the instant lawsuit is unlawful and thus, it is so decided as per Disposition by the assent of all participating Justices.
