1. The defendant

A. 1) Plaintiff A: 35,070,930 won; 2) Plaintiff B, 46,848,200 won; 3) Plaintiff C, 41,98,060 won, 4).

Reasons

1. Facts of recognition;

A. The defendant is a school foundation that operates M University (hereinafter "Defendant University"), and the plaintiffs are professors working in the defendant University.

B. Article 53-2(3) of the Private School Act provides that “The remuneration of teachers of a college educational institution shall be determined separately by the rules of the board of directors, depending on qualifications, experience, difficulty in duties and degree of responsibility.” Article 45 of the Articles of incorporation provides that “The remuneration of teachers shall be determined by the rules of the board of directors,” Article 2 of the Regulations on the Remuneration of Teachers and Staff, except as otherwise provided for in this provision, may apply mutatis mutandis to remuneration of teachers and staff of a college educational institution. In cases of the implementation of the annual salary system, detailed matters concerning the operation thereof shall be determined separately by the president.”

(2) The term "annual salary" means the total annual remuneration, excluding other allowances.

(3) A monthly amount of an annual salary shall be an annual salary.
